Terms of Sale

These terms of sale (the "Terms") govern product sales made on saphek.com (the "Site"), in particular the NFC Google review cards and custom NFC products. They are intended for professionals and businesses.

Specific terms may be displayed on an offer's page (for example the "Terms of sale of this offer" on the NFC cards page). They complement these Terms and prevail in case of conflict for the offer concerned.

Any order placed on the Site implies acceptance of these Terms, accessible at any time from the footer and restated before payment.

Products are sold by Pierre MADI EI, a French sole proprietorship registered with the Paris Trade and Companies Register (RCS) under number 979 944 345, operating under the "Saphek" brand.

The Site offers in particular:

• NFC Google review cards: cards with Saphek's design, wording printed in French, programmed before shipping with the link chosen by the client (usually their Google review page), endlessly reprogrammable with a free NFC app, optional password protection;
• Custom NFC products (another language, another format: plaque, badge, table stand, custom wording, international delivery): on quotation, via WhatsApp. Every request is reviewed.

Photographs and visuals on the Site are as accurate as possible but are not contractually binding on non-essential details.

Prices are stated in euros. Product prices and applicable delivery fees are displayed before any payment, in the order summary and on the payment page. Depending on the publisher's tax regime (sole proprietorship under the French micro-enterprise regime), where applicable: VAT not applicable, article 293 B of the French Tax Code.

Promotional offers (such as the NFC cards launch price) are valid while stocks last and may be changed or withdrawn at any time; the applicable price is the one displayed at the time of ordering.

Orders are placed online via the product page form, followed by secure Stripe payment (card, Apple Pay, Google Pay - SSL encryption and 3D Secure). Saphek never has access to full card details.

The contract is formed upon payment confirmation. A receipt is emailed immediately. Saphek reserves the right to refuse or cancel (with a full refund) any order of an abnormal or fraudulent nature.

Stock is limited. When it runs out, the Site clearly says so on the product page and any new order becomes a preorder: shipping within 30 days at the latest, restated before payment (on the page and on the payment screen). Payment is taken at the time of order and preorders ship first as soon as stock arrives.

Delivery to metropolitan France only, Corsica included (for other countries: custom order via WhatsApp). All shipments are tracked: "Tracked delivery" or "Colissimo tracked parcel" depending on quantity. Fees are displayed before payment and free from 100 cards.

Outside preorders, orders are dispatched within 1 business day. Carrier transit times (usually 2 to 5 business days) remain indicative.

Risk passes upon delivery of the parcel to the address provided by the client. If the client provides a wrong or incomplete address, reshipping costs are borne by the client.

If the products are not suitable, the client may write to contact@saphek.com within 30 days of delivery: the price of the products is refunded on simple request, no justification needed, once the complete products are returned to the address provided by Saphek.

Return shipping costs are borne by the client; initial delivery fees are not refunded. The refund is made within 7 days of receiving the return, to the original payment method.

Defective or damaged product: replacement or full refund, no return required; a photo or short video is enough.

As the Site's offers are reserved for professionals, French consumer-law provisions (notably the 14-day right of withdrawal and consumer mediation) do not apply. In addition, NFC cards programmed with the client's link are personalized goods, excluded from the right of withdrawal (article L221-28 of the French Consumer Code).

The "30-day money-back" commercial warranty above remains applicable and more favourable.

The client benefits from the legal warranties applicable to their situation, notably the legal warranty of conformity and the warranty against hidden defects (articles 1641 et seq. of the French Civil Code). To exercise them: contact@saphek.com.

Purchased products belong to the client: they may use them for their business, give them away or resell them freely, at any price. The only limit: not presenting oneself as Saphek; the brand and the Site's contents remain the property of their publisher (see legal notice).

The cards are programmed with a redirect link provided by Saphek (saphek.com/r/), which counts uses then opens the client's review page. This service is provided and maintained free of charge; the cards remain reprogrammable to any direct link at any time, with no dependency on Saphek.

The volume of reviews obtained depends on end customers and is not guaranteed. Products must be used in compliance with the rules of the platforms concerned (Google in particular): only invite real customers, never buy reviews.

Data collected at the time of ordering is processed to perform the contract (payment via Stripe, preparation, shipping, tracking) and in accordance with the Site's privacy policy, which details processing activities, retention periods and the client's rights.

These Terms are governed by French law. In case of difficulty, the client is invited to first contact contact@saphek.com: an amicable solution is always sought, quickly. Failing an amicable agreement, the courts of Paris shall have jurisdiction.
